Terms and Conditions

These Terms and Conditions govern the use of the sippulse.com website, the mobile applications published by SipPulse (including the CrossCall softphone) and the services contracted from SipPulse Soluções em Telecomunicações Ltda. ("SipPulse"). By using any of these products, you fully agree to these terms.

1. Acceptance of terms

By creating an account, configuring SIP credentials, installing our applications or contracting services, you confirm that you have read, understood and accepted these Terms and Conditions and our Privacy Policy. If you do not agree, do not use our products and services.

2. Description of services

SipPulse provides, among others:

  • Software platforms for telecom operators (SoftSwitch, SBC, BCW, IVR, BSS, call classifier)
  • Mobile softphone applications (CrossCall) for SIP registration and voice/video calls
  • Informational content, documentation, training and blog

3. Registration and credentials

You are responsible for the accuracy of the information provided at registration and for safeguarding your SIP and access credentials. Any activity carried out with your credentials is entirely your responsibility. Notify SipPulse immediately in case of suspected unauthorized use.

4. Use of mobile applications

By using our mobile applications, you agree to:

  • Use the app only with valid SIP credentials provided by you or your authorized administrator
  • Comply with applicable telecommunications regulations (Anatel in Brazil, local carriers, number portability and calling line identification rules)
  • Not use the application for mass automated calls, abusive telemarketing, caller ID spoofing, harassment or any unlawful purpose
  • Respect the rules of application stores (App Store and Google Play) and notification platforms (Apple APNs and Google FCM)
  • Not reverse engineer, decompile or attempt to compromise the security of the application

5. Prohibited uses

It is expressly prohibited to use SipPulse products and services for:

  • Illegal activities or activities that violate local, national or international laws
  • Violations of the LGPD, GDPR or any other data protection regulation
  • Abusive telemarketing, unsolicited commercial calls or violations of do-not-call rules
  • Spam, sending unsolicited bulk messages by voice, SMS or WhatsApp
  • Fraud, phishing, social engineering, caller ID spoofing or any deceptive practice
  • Harassment, threats, hate speech or abusive communications
  • Transmission of malware, viruses or malicious code

6. Prices, payment and taxes

Prices, payment terms and applicable taxes are defined in the commercial contract or specific proposal accepted by the customer. Late payment may result in suspension or termination of the services and application of the charges provided for in the contract. Free use of mobile applications does not, in itself, create any obligation of support, SLA or availability.

7. Intellectual property

All rights to the software, source code, trademarks, logos, website content, documentation and educational materials are the exclusive property of SipPulse or its licensors and are protected by Brazilian and international intellectual property laws. The use of the products does not transfer any rights to such property, except for the limited license to use expressly provided for in the contract.

8. Limitation of liability

To the maximum extent permitted by law, SipPulse shall not be liable for indirect, incidental damages, loss of profits, loss of data or business interruption arising from the use of or inability to use the products. SipPulse's total liability, under any circumstances, is limited to the amount actually paid by the customer in the 12 months prior to the event giving rise to the claim.

9. Warranties and availability

Products are provided "as is" for free use. For services contracted under a commercial agreement, the applicable warranties and service levels (SLA) are those expressly defined in the specific contractual instrument.

10. Suspension and termination

SipPulse may suspend or terminate access to any product or service, at any time, in the event of violation of these terms, default, fraudulent use or risk to the integrity of the platforms. The user may terminate use of the mobile applications at any time by uninstalling the application.

11. Changes to the terms

SipPulse may modify these Terms and Conditions at any time. Material changes will be communicated with reasonable prior notice through the website and, when applicable, through the applications. Continued use after publication implies acceptance of the updated version.

12. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Federative Republic of Brazil. The venue of the District of Florianópolis, state of Santa Catarina, is hereby elected to settle any disputes arising from this instrument, with express waiver of any other, however privileged it may be.
